Terms of Service

1. Who this agreement is with

These terms are between you and HomeUpgraders, operated by Ryan Trebell in Orléans, Ontario. By creating an account or using the tools you agree to them. If you do not agree, do not use the service.

2. What the service is

HomeUpgraders provides software for planning, recording and invoicing renovation work. We provide tools. We do not perform your construction work, supervise it, or take responsibility for it.

3. What the service is not

Nothing here is professional advice. Our tools do not provide legal, accounting, tax, engineering, architectural or building-code advice. Output is a starting point for your own judgement, not a substitute for a qualified professional or for the authority having jurisdiction.

Not a code authority. Where we present building-code information, it is a reference and may be incomplete, out of date, or wrong. Your municipality, your building inspector and the current Ontario Building Code decide what is compliant. Never build from our output alone.
Not an accountant. Margin, overhead, tax and expense calculations are arithmetic on numbers you supply. Verify them before filing anything.
Not a measurement instrument. Scans, room dimensions and derived quantities are estimates. Measure before you order or cut.

4. Your account

You are responsible for your password and for what happens under your account. Tell us promptly if you think it has been used without your permission. One account is for one person or business; do not share sign-in credentials.

5. Your data belongs to you

Your jobs, records, photographs, rates and client information remain yours. We store and process them to run the service, as described in the Privacy Policy. We claim no ownership and we do not use your job data to train our own AI models. You can ask for a copy or a deletion at any time.

6. Your clients' information — your responsibility

When you enter a homeowner's name, address, phone or photographs of their home, you are collecting someone else's personal information. You are responsible for having a proper basis to do so, for telling them how it is used, and for handling their requests about it. We store it for you; we are not the party that collected it from them.

You agree not to upload information you have no right to hold, and not to use the service to record anyone without the consent the law requires.

7. Acceptable use

Do not use the service to break the law, infringe anyone's rights, attempt to reach another user's data, probe or attack the system, scrape it in bulk, or resell access. We may suspend an account that does.

8. Paid features

Some features cost money. Prices are shown before you buy. Payments are handled by Stripe; we never see your card number. Where you buy credits or a subscription, what you get is stated at purchase.

Refunds. If a paid feature does not work as described, contact us and we will refund it. Consumer protection law in Ontario gives you rights that these terms do not reduce.

Comped access. Free access granted by invitation carries no fee and no service commitment. It may be withdrawn, but if it is, you keep read access and the ability to export your records.

9. Availability

We do not promise the service will always be available. It may be interrupted for maintenance, by a provider outage, or by a fault. Keep your own copies of anything you cannot afford to lose. The print and export functions exist for that reason.

10. Limits on our liability

To the extent the law allows, we are not liable for indirect or consequential losses — lost profit, lost work, a rejected inspection, or a dispute with your client — arising from use of the service. Our total liability is limited to what you have paid us in the twelve months before the claim, or one hundred Canadian dollars if you have paid nothing.

Nothing in these terms limits liability that cannot be limited by law, including under Ontario's Consumer Protection Act, 2002 where it applies to you.

11. Ending it

You may close your account at any time and export your records first. We may suspend or close an account that breaches these terms, and we will tell you why unless we are legally prevented. If we close your account other than for a breach, you get a reasonable opportunity to export your data.

12. Changes

We may change these terms. If a change is material we will ask you to read and accept the new version before continuing. The version date at the top identifies what you agreed to, and your acceptance is recorded against that version.

13. Governing law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada. Disputes go to the courts of Ontario. This does not remove any right you have to complain to a regulator or to use small claims court.
